Purpose and scope

By booking the offer, the participant acknowledges and accepts these General Terms and Conditions as an integral part of the contractual relationship between FitCube and the participant.

Dates

The type and scope of the service units are agreed with the participant and/or are based on the information in the respective booking description. Training units are only provided against prior booking via the billing system. The booking is binding. When booking a service area, the customer has no right to performance by a particular specialist.

Power units

Performance sessions consist of training, counseling or therapy sessions.

Payment method

The service units and subscriptions are paid in advance. The offers can be paid against invoice, payable within 20 days net. The participant falls into arrears without further reminder after expiry of the payment deadline.

Bookings

Prevention & Cancellation The appointments are to be kept by the participant. In case of prevention, the participant must cancel the booking at least 24 hours before the start of a performance unit via the booking system by email or call the studio.

Postponement & Refund

If cancelled in time, appointments can be taken at another time. The participant has to book a new training session via the MindBody system for this purpose. There is no right to a refund of the price.

Failure of the specialist

If the service unit cannot be performed by the booked specialist, the participant agrees to take it up with another specialist who is available at the time booked. If no specialist can be provided by FitCube at the time booked, the booked service unit will not be carried out and the participant will be credited. In the event of a failure, FitCube will endeavor to provide immediate notification and will inform the customer using the contact details known to it. Any damages incurred by the participant as a result of such cancellations and/or schedule changes will not be compensated by FitCube.

Subscriptions:

The 25 Personal Training subscription is valid for 12 months and includes 25 Personal Training sessions of 55 minutes each. The 10-person subscription Personal Training has a duration of 6 months and includes 10 personal training sessions of 55 minutes each. The 10-subscription Physiotherapy Self-Pay has a duration of 6 months and includes 10 therapy sessions of 25 minutes each. Subscribers of a subscription can only make up appointments not attended within the period of the current subscription. If the participant does not cancel the appointment or does not cancel it in time (see appointments above), the training session will be charged. If the subscription is not used within the specified period or a training session is not attended or booked, there is NO right to a refund of the price. In the event of prolonged illness or accident, the duration not used due to illness or accident can be credited or refunded at the discretion of FitCube upon presentation of a doctor's certificate.

Operating hours

The Fitness Academy is open during operating hours with the exception of event days. Information about the operating hours or special opening hours will be announced in good time on the homepage and in the studio.

Insurance / Disclaimer

Insurance is the responsibility of the participants. The training sessions are designed for adults, children with parental consent and healthy participants. Participants are obliged to inform FitCube of any existing injuries, physical complaints or limitations. FitCube assumes no liability for accidents and damages of any kind suffered by the participant while using the services.

Medical history (health questionnaire)

Completion of the medical history (health questionnaire) is mandatory and will be completed together with a specialist at the 1st training session at the latest.

Participants are obliged to answer the questions truthfully and to inform FitCube if a change in health should occur during the contract period. In the event of any health risks, FitCube may require the participant to undergo a medical examination.

House rules

The participant accepts the house rules in their current version.

Privacy policy

The data and personal details collected during the registration process are used exclusively for the purpose of complete order fulfillment.

Changes to these General Terms and Conditions

FitCube reserves the right to unilaterally amend these General Terms and Conditions at any time. The current version of the General Terms and Conditions will always be published on the Website.

Jurisdiction and applicable law

All legal relationships between the Participant and FitCube are governed exclusively by Swiss law. The exclusive place of jurisdiction for all disputes arising from or in connection with these General Terms and Conditions is the registered office of FitCube.
